PROCEDURE AND CONDITIONS OF CUSTOM (CONTRACT) WORKS
Initial condition. Work can be started only after
the ICSTI will preliminary determine that subjects and amount of
work indicated by the customer are within the framework of practical
capacity and interests of potential performers.
Confidentiality. All information granted by the
prospective customer will be protected (at his/its will) by a non-disclosure
agreement, concluded between the ICSTI and the customer, and is
executory for a research team of the performer.
Search for a performer is realized on the basis
of the brief written description of the project, its duration and
scale, the required research and measuring equipment, other instruments
and tools, and also expected outcome of the project.
Search fee. It is determined by the ICSTI for each
case on the basis of the forecast of concrete search cost according
to the obtained description of the project. The fee covers the time
spent by experts, cost of communication and document preparation.
Probable expenditures for trip to the potential performer and other
incidental expenses are paid by the customer on the basis of a preliminary
arrangement.
Information on a potential performer is granted
by the ICSTI to the customer as a brief anonymous description of
the found performer: his/its qualification, experience and achievements,
technical and laboratory equipment and a preliminary assessment
of an execution time and cost of the project.
Conditions of a search fee return. If a customer
is not satisfied with results of the search the ICSTI has carried
out, he/it can get back 60% of the search fee or a new search can
be carried out on his/its request for modified description of the
project. After the second search, in case of the customer dissatisfaction
about its result, it is returned 30% of the search fee or the third
search is ordered after which the search fee will be not subject
to return.
Preparation of the contract. All major provisions
of the contract regulating the responsibilities of the research
project performer, a schedule, procedures of accounting and contract
payment are developed by the customer and the ICSTI jointly on the
basis of negotiation.
Intellectual property rights to inventions, created
during fulfillment of contract operations, are owned by the contractor
in exchange for negotiated percentage allocations to the customer
of operations.
Supervision over the project execution is carried
out by the ICSTI which monitors execution of all the contract provisions
and in stipulated periods informs the customer on progress of work.
Administration fee is paid the ICSTI by customer
at the rate of 7 to 15 % from a total cost of the project depending
on the contract scale and complexity of work on hand. This fee does
not include payment of transfer of samples or prototypes during
the project execution.
Additional responsibilities of the customer. For
five years after the contract term expiration the customer engages
oneself not to contract with the performer without the ICSTI knowledge
and participation.
